The establishment of the CEA marks the next stage in the evolution of company law enforcement in this jurisdiction. 

Compliance with, and the enforcement of, company law has developed beyond recognition since the late 1990s, when the view was expressed in the McDowell Report that “Those who are tempted to make serious breaches of company law have little reason to fear detection or prosecution. As far as enforcement is concerned, the sound of the enforcer’s footsteps on the beat is simply never heard”. Directors of insolvent companies are now routinely restricted and disqualified as a consequence of their behaviour, civil enforcement measures and criminal prosecutions are a regular occurrence and the financial and reputational risks associated with being the subject of enforcement action are such that compliance with legal obligations is high on all responsible Boards’ agendas.
